Welcome to Rugmonde, a brand owned and operated by Rugmonde SAS. These Terms and Conditions govern your use of our e-commerce platform and the purchase of products listed on phiore.com. By accessing or using the Platform, you agree to these Terms. If you do not agree, please refrain from using the Platform.

1. Introduction

Phiore is an e-commerce platform offering a curated selection of premium home decor products sourced globally, including artisanal designs. The platform is owned by Rugmonde SAS, registered in France. While Phiore serves as the brand, Rugmonde SAS facilitates transactions and ensures compliance with all legal obligations.

2. Intellectual Property

2.1. Supplier Designs

All designs, trademarks, logos, and other intellectual property associated with the products listed on Phiore remain the exclusive property of the respective suppliers or artisans. Suppliers retain full rights to their designs and intellectual property.

2.2. Platform Content

All content on the Phiore platform—including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software—is the property of Rugmonde SAS or its content suppliers. This content is protected by international copyright laws and other intellectual property rights.

3. Copyright and Design Infringement

3.1. Respect for Intellectual Property

Phiore values and respects the intellectual property rights of others and expects users and suppliers to do the same. Claims of copyright or design infringement are taken seriously and addressed promptly.

3.2. Supplier Assurances

Suppliers offering products on Phiore warrant that they possess all necessary rights, licenses, consents, and permissions to sell their products. They affirm that their designs do not infringe upon any third-party intellectual property rights.

3.3. Reporting Infringement

If you believe your intellectual property has been infringed, please contact us at team@phiore.com with the following details:

  • A description of the copyrighted work or design allegedly infringed.
  • A description of where the alleged infringing material is located on the Platform.
  • Your contact information (address, phone number, and email).
  • A statement of good faith belief that the disputed use is unauthorized.
  • A statement under penalty of perjury that your notice is accurate and that you are the intellectual property owner or authorized to act on their behalf.
3.4. Consequences of Infringement

Upon receipt of a valid infringement notice, we may remove or disable access to the allegedly infringing material. Repeat infringers may have their accounts terminated and permanently banned from the Platform.

4. Indemnification

Suppliers agree to indemnify, defend, and hold harmless Rugmonde SAS, Phiore, and their affiliates, directors, officers, employees, and agents against all claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from any claim that their designs or products infringe on third-party intellectual property rights.

5. Limitation of Liability

To the fullest extent permitted by law, neither Rugmonde SAS nor Phiore shall be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from:

  • Use or inability to use the Platform.
  • Unauthorized access to or use of servers or personal information.
  • Interruption of transmission to or from the Platform.
  • Bugs, viruses, or harmful code transmitted via the Platform.
  • Errors or omissions in any content.

6. Changes to Terms

Phiore, through Rugmonde SAS, reserves the right to modify these Terms at any time. Changes are effective immediately upon posting on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.

7. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
